1. About this policy

Desert Scientific Software Pty Ltd (ABN 29 092 442 334 ("DesertSci", "we", "us" or "our") is committed to protecting the privacy of individuals who visit our website at www.desertsci.com (the "Website") or otherwise interact with us. This Privacy Policy explains what personal information we collect through the Website, how we use and disclose it, and how you can access or correct your information or make a complaint.

We are based in Thornleigh, New South Wales, Australia, and we handle personal information in accordance with the Privacy Act 1988 (Cth) and the Australian Privacy Principles (APPs).

This Policy applies to the Website only. It does not apply to personal or other data that our software customers process within their own Proasis deployments or environments, which remains within the customer's own systems and control and is governed by the relevant customer agreement, not this Policy.

2. Information we collect

We only collect personal information that is reasonably necessary for our functions and activities. Depending on how you interact with the Website, we may collect:

  • Contact and enquiry information: such as your name, email address, company or organisation, job title, phone number and the content of any message, when you submit a contact form or request a demo.
  • Newsletter subscription information: such as your name and email address, when you subscribe to receive updates or content from us.
  • Technical and usage information: such as your IP address, browser type and version, device type, operating system, pages viewed, referring website, and the date, time and duration of your visit, collected automatically through cookies and similar analytics technologies (see Section 4).
  • Any other information you choose to provide to us, for example in correspondence or through Linkedin or other channels linked from the Website.

We do not knowingly collect sensitive information (as defined in the Privacy Act) through the Website, and we askthat you do not include sensitive information in any form submission or message to us.

3. How we use your information

We use personal information collected through the Website to:

  • respond to enquiries and demo requests, and communicate with you about Proasis and our other products and services;
  • send newsletters, thought-leadership content or other updates you have subscribed to, or unsubscribed you if you request this;
  • understand how visitors use the Website, and to maintain, test and improve its performance, security and content;
  • comply with our legal obligations and protect our legal rights; and for any other purpose disclosed to you at the time of collection, or with your consent.

We do not use personal information collected through the Website for automated decision-making that produces legal or similarly significant effects.

Any newsletters or marketing communications we send are provided in accordance with the Spam Act 2003 (Cth),including obtaining your consent, identifying us as the sender, and including a functional unsubscribe facility inevery message.

4. Cookies and analytics

The Website uses cookies and similar technologies, including analytics cookies (such as Google Analytics), to understand visitor behaviour and improve the Website. Cookies are small text files stored on your device.

The types of cookies we may use include:

  • Analytics cookies: collect aggregated, non-identifying information about how visitors use the Website (e.g. pages visited, time on site, general location).

  • professional advisers, such as our lawyers and accountants, where reasonably necessary; and regulatory or government bodies, or other third parties, where required or authorised by law.

6. Overseas disclosure 

Some of the service providers referred to in Section 5 (for example, analytics, email and newsletter platforms) may store or process personal information on servers located outside Australia, including in the United States. Where this occurs, we take reasonable steps to ensure that overseas recipients handle personal information consistently with the Australian Privacy Principles, including through the provider's own privacy and security commitments. 

7. Data security and retention

We take reasonable technical and organisational steps to protect personal information collected through the Website from misuse, interference, loss, and unauthorised access, modification or disclosure. However, no method of transmission over the internet or electronic storage is completely secure, and we cannot guarantee absolute security.

We retain personal information collected through the Website only for as long as reasonably necessary to fulfil the purposes described in this Policy, or as required by law, after which it is securely deleted or de-identified. 

If we experience a data breach involving personal information that is likely to result in serious harm, we will notify affected individuals and the Office of the Australian Information Commissioner (OAIC) in accordance with the Notifiable Data Breaches scheme under Part IIIC of the Privacy Act 1988 (Cth).

8. Your rights 

Under the Australian Privacy Principles, you may: 

● request access to the personal information we hold about you; 

● request correction of any personal information that is inaccurate, out of date or incomplete; 

● unsubscribe from our newsletter or marketing communications at any time, using the unsubscribe link in any email or by contacting us directly; and make a complaint about how we have handled your personal information. 

To exercise any of these rights, please contact us using the details in Section 11. If you are not satisfied with our response to a complaint, you may lodge a complaint with the Office of the Australian Information Commissioner (OAIC) at www.oaic.gov.au. 

9. Children's privacy 

The Website is directed at business professionals and is not intended for use by children. We do not knowingly collect personal information from children through the Website. 

10. Links to other websites 

The Website may contain links to third-party websites, including LinkedIn and other professional or industry sites. We are not responsible for the privacy practices or content of those third-party websites, and we encourage you to review their privacy policies.
